PRACTITIONER SELLING STANDARDS
OPTIMAL SLEEP AIRWAY HEALTH

These standards apply to all OSAH account holders including practitioners, clinics, retail stores and students.
1. Compliance with these Standards
These OSAH Practitioner Selling Standards form part of the conditions on which Optimal Sleep Airway Health (OSAH) supplies its practitioner‑only products and grants or maintains practitioner accounts.
By applying for, holding or using an OSAH approved practitioner account, each Account Holder agrees to comply with:
- these OSAH Practitioner Selling Standards
- the OSAH Website Terms and Conditions, as published on our website: https://optimalsleepairwayhealth.com
- any additional written policies we publish or notify to you from time to time
- all Applicable Laws
OSAH may update these Practitioner Selling Standards periodically, with updated versions published on our website or otherwise notified to Account Holders.
2. Eligibility
OSAH supplies its practitioner‑only gummy products exclusively to:
- Complementary Medicine Health Professionals (CMHPs) and other eligible registered health professionals.
- Businesses that employ or engage eligible practitioners.
- Retail pharmacies and health food stores that meet these standards.
- Eligible students under supervision.
These standards are designed so that OSAH products are used under the guidance of a suitably qualified health professional and in accordance with Applicable Laws.
3. OSAH Practitioner Account Requirements
To open and maintain an OSAH approved practitioner account, an applicant must be:
- an eligible CMHP or registered health professional practising an Approved Modality, or
- a Business employing or engaging CMHPs or registered health professionals, or
- an eligible student or Retail Store, subject to the additional obligations below.
A CMHP or registered health professional must:
- Hold a relevant qualification issued by a Registered Training Organisation or recognised Australian University in an Approved Modality, or an equivalent recognised qualification.
- Be a current professional member of a relevant association or hold registration with the appropriate Australian health practitioner board, as applicable.
- Hold appropriate professional indemnity and public liability insurance (in the name of the practitioner, Business or Retail Store, as applicable).
A Business may be granted an Account if the application includes details of one or more eligible practitioners employed or engaged by the Business.
Account Holders must promptly notify OSAH of any material change to their business or professional status, including any change in the availability or employment of practitioners at the Business Premises.
International applicants and practitioners with international qualifications will be assessed case‑by‑case, having regard to Applicable Laws.
4. Consultation and Supply to Patients
OSAH practitioner‑only products are intended to be supplied to patients following a professional consultation with an eligible practitioner.
A CMHP or other eligible practitioner may only supply OSAH practitioner‑only products to a patient after:
- completion of a consultation (in person or via telehealth)
- provision of clear written usage instructions or an internal prescription record for that patient (for example, via practice software or a prescription pad).
5. Business and Practitioner Obligations
A Business or practitioner Account Holder acknowledges and agrees that:
- They must always comply with these OSAH Practitioner Selling Standards and any other OSAH policies provided or published from time to time.
- They will securely maintain patient records (including any prescriptions or written usage instructions) and comply with all Applicable Laws, including privacy and confidentiality obligations relating to personal and health information.
- They must only recommend or supply practitioner‑only OSAH products to their own patients, unless they receive appropriate written instructions or a valid prescription from another treating practitioner.
- They must ensure appropriate labelling or documentation accompanies each dispensed product, in accordance with Applicable Laws and professional standards, including usage instructions for the patient.
6. Student Access and Supervised Dispensing
1. A student may apply for an OSAH account (or be linked to a clinic account) if they are:
- enrolled with a recognised Registered Training Organisation or university, and
- participating in relevant practical clinical subjects, and
- a student member of a relevant professional association where applicable.
2. The student must provide documentary evidence of their enrolment and association membership on reasonable request by OSAH.
3. Products supplied to a student are for personal educational and training use only.
4. A student must not independently prescribe, sell, supply or distribute OSAH practitioner‑only products; any involvement must be under the direct supervision of an eligible practitioner within a clinical or educational setting that complies with these standards and Applicable Laws.
7. Retail Pharmacies and Health Stores
Where OSAH allows supply through a Retail Store (such as pharmacies or health food stores), the following apply:
- Retail Stores may supply OSAH practitioner‑only products to patients only:
- on the basis of a valid prescription or written instruction from an eligible practitioner, or
- after a consultation with an eligible practitioner conducted in an appropriate consultation area.
- Shop‑floor discussions between staff and customers do not constitute a consultation for the purposes of these standards.
- Retail Stores without a private consultation room may only dispense practitioner‑only products on receipt of a valid prescription or written instruction from an eligible practitioner and must retain appropriate records as required by Applicable Laws.
- Retail Stores must store practitioner‑only OSAH products securely, out of sight and reach of the general public, separate from general retail products, except where products are clearly located within a designated consultation area.
8. Online Visibility and Advertising Restrictions
OSAH practitioner‑only products must not advertise, market, promote or otherwise make Products available for sale online to the general public (including via any website, third-party platform or social media) without Our prior written consent.
Without OSAH’s prior written approval:
1. Account Holders must not promote practitioner‑only OSAH products on public websites, third‑party platforms, or social media in a way that constitutes advertising to consumers (for example, by making product‑specific therapeutic claims to the general public).
2. Any online content about practitioner‑only products should be directed to health professionals only or restricted to password‑protected areas for patients already under the care of an eligible practitioner. Any online advertising must be limited to product names and images approved by Us and any additional Product information (including pricing, dosage or claims that We approve) must only be accessible within password-protected areas restricted to the Account Holder and Patients.
3. Where OSAH gives written consent for online ordering systems which are password protected, access should be limited to patients following verification of their practitioner relationship and recommended product(s).
4. Any online system used by an Account Holder must ensure the prescribing CMHP retains control over patient dispensing, including the ability to amend, cancel or vary Scripts and repeats.
5. Account Holders are responsible for ensuring that all online and offline promotion and advertising of OSAH products complies with all Australian Laws and any relevant professional codes.
9. Your Obligations to OSAH and Patients
Each Account Holder:
1. Is responsible for obtaining independent legal or regulatory advice about their own compliance obligations or otherwise accepts that they proceed at their own risk.
2. Must advise patients on appropriate steps to take in the event of any adverse reaction or unexpected outcome related to OSAH products.
3. Must promptly notify OSAH of any known or suspected serious adverse reaction related to OSAH products, abiding by any applicable Laws. Please email contact@optimalsleepairwayhealth.com
10. OSAH Rights
OSAH reserves the right to:
1. Decline any application for an Account or require that an application be amended and resubmitted.
2. Review, audit and assess an Account Holder’s practice and procedures in relation to OSAH products, including product sales, dispensing history and adherence to these standards.
3. Suspend or terminate an Account for breach of these selling standards or Applicable Laws, without notice. We will, however, provide the relevant Account Holder with a reasonable opportunity to respond in writing to any suspension or termination within 15 Business Days of our notice to suspend or terminate the Account and respond to any such submission in writing within 20 Business Days of receipt of same.
4. Reactivate an Account (including instructing an Authorised Distributor to reactivate any Account) if OSAH is satisfied that the breach has been remedied and that the Account Holder will comply with these standards going forward.
11. Key Definitions
Unless the context otherwise requires:
- Account means a purchasing account with OSAH (including via an Authorised Distributor) in the name of an Account Holder.
- Account Holder means any person or entity approved by OSAH (including via an Authorised Distributor) to hold an Account, including practitioners, students, businesses and eligible Retail Stores.
- Applicable Laws means all laws, regulations, rules and codes that apply to the OSAH products in Australia (and in any other relevant jurisdiction), including their manufacture, supply, promotion, and sale.
- Authorised Distributor means a distributor of complementary medicines who is approved by Us to sell Products to any Account Holder and who has agreed to always comply with Selling Standards.
- Approved Modality includes recognised healthcare professions that OSAH permits to dispense practitioner‑only products
- Acupuncture
- Chiropractor
- Dentist
- Dietitian
- Dietitian (sports)
- Herbalist
- Medical Doctor
- Midwife
- Naturopath
- Registered Nurse
- Nutritionist
- Optometrist
- Osteopath
- Podiatrist
- Pharmacist
- Physiotherapist
- Psychologist
- Traditional Chinese Medicine Practitioner
- Veterinarian
and other recognised modalities as updated by OSAH from time to time.
- Business means an Australian registered company, partnership or sole trader holding an ABN that owns, directs or operates a practice or retail premises and employs or engages eligible practitioners.
- Business Premises means the premises where an Account Holder conducts their business and from which OSAH products are sold or dispensed.
- CMHP means a complementary medicine health professional who meets the relevant qualification and professional association requirements under Australian therapeutic goods legislation.
- Consultation means a professional consultation between an eligible practitioner and a patient, conducted in person or via telehealth, in a private consultation space appropriate for clinical care.
- Patient means a patient or client of an Account Holder receiving professional advice from an eligible practitioner in relation to OSAH products.
- Practitioner‑only products means OSAH products designated by OSAH as available only through, or on the recommendation of, an eligible practitioner.
- Retail Store means a community pharmacy, health food store, or similar outlet that meets the requirements of these standards and any additional conditions notified by OSAH.
- Script” means a prescription provided by the CMHP to the Patient which includes:
- prescribing CMHP’s name, clinic name, location, contact details and signature;
- date of Script issue and Patient details;
- dosage and directions for Patient’s use of each Product;
- instructions if Patient suffers adverse reaction in respect of any Product;
- number of repeats, if any, per Product; and
- Script reference number (if applicable).
To be clear, a screenshot from Our or Authorised Distributor’s patient ordering system does not constitute a valid Script.
- Selling Standards” means this document which govern Our requirements of any CMHP, Student, Business, or Retail Store that opens Account with Us and becomes an Account Holder.
- Student means a person enrolled with a recognised Registered Training Organisation or university undertaking study in an Approved Modality.
- We / Us / Our means Optimal Sleep Airway Health (OSAH).
